Please read these Terms of Service ("Terms") carefully before using Echo Loop.

These Terms govern your use of the Echo Loop mobile applications, website (echo-loop.top), and related services (collectively, the "Services") provided by Echo Loop ("we", "us", or "our").

By downloading, installing, or using Echo Loop, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By accessing or using the Services, you represent that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

If you are using the Services on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Description of Services

Echo Loop is a language learning platform that provides:

• Intensive Listening Practice: Audio playback with word-by-word highlighting
• AI-Powered Transcription: Automatic speech-to-text with word-level timestamps
• Spaced Repetition System: Review difficult sentences on an optimized schedule
• Bookmarks & Vocabulary: Save sentences and words for later review
• Cross-Platform Sync: Access your learning progress on iOS, Android, Windows, and Mac

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Keep your account information up to date
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Suspension and Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or disrupt the Services.

4. License and Restrictions

4.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Echo Loop app on your personal devices
• Access and use the Services for personal, non-commercial purposes

4.2 Restrictions

You agree not to:

• Copy, modify, or distribute the Services without authorization
• Reverse engineer, decompile, or disassemble the app
• Use the Services for any illegal or unauthorized purpose
• Interfere with or disrupt the Services or servers
• Attempt to gain unauthorized access to any part of the Services
• Use automated systems or bots to access the Services
• Resell or commercially exploit the Services
• Redistribute learning materials or transcription results

5. User Content

5.1 Your Content

You retain ownership of any audio files, annotations, or other content you upload ("User Content"). By uploading content, you grant us a license to process, store, and display it solely for the purpose of providing the Services.

5.2 Content Responsibility

You are solely responsible for ensuring that your User Content:

• Does not infringe any third-party intellectual property rights
• Does not contain illegal, harmful, or offensive material
• Complies with all applicable laws and regulations

We disclaim any liability for damages arising from User Content.

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

6. Intellectual Property

6.1 Our Property

Echo Loop, including its design, features, and content (excluding User Content), is owned by us and protected by intellectual property laws. The Echo Loop name, logo, and related marks are our trademarks.

6.2 Feedback

If you provide suggestions or feedback about the Services, you grant us the right to use such feedback without compensation or attribution.

7. Subscription and Payments

7.1 Free and Premium Services

Echo Loop offers both free and premium subscription tiers. Premium features require a paid subscription.

7.2 Payment Terms

• Subscriptions are billed in advance on a recurring basis (monthly or yearly)
• Payment is processed through the Apple App Store, Google Play, or our website via Stripe
• Prices are subject to change with reasonable notice

7.3 Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You will be charged the same subscription fee for each renewal period.

7.4 Cancellation

• You may cancel your subscription at any time through your app store account settings or in-app settings
• Cancellation takes effect at the end of the current billing period
• You will continue to have access to premium features until the end of the paid period
• No cancellation fees apply
• After cancellation, your account reverts to the free tier
• You may resubscribe at any time

7.5 Refund Policy

• Refund requests must be submitted within 30 days of purchase
• Refunds may apply to unused subscription periods or subscriptions used for less than 7 days
• Refunds will not be granted if more than 50% of the subscription period has elapsed
• Processing takes 5–10 business days; refunds are issued to the original payment method
• We reserve the right to deny refunds for violations of these Terms
• Free services and promotional offers are not eligible for refunds
• For app store purchases, refunds are subject to the policies of the applicable app store

8. Account Deletion

8.1 How to Delete

You may request complete account deletion at any time through the in-app settings or by contacting support@echo-loop.top.

8.2 Effects of Deletion

• All personal data and learning progress will be permanently deleted
• This action is irreversible
• Active subscriptions will be cancelled
• Personal data is deleted within 30 days of the deletion request

8.3 Data Retention After Deletion

• Some data may be retained as required by law (e.g., payment records for tax purposes)
• Anonymized, aggregated analytical data may be retained for service improvement
• No personally identifiable information is retained after the deletion period

9. Third-Party Services

9.1 AI Transcription Providers

We use third-party AI services (such as Deepgram, OpenAI, Google Cloud, Azure) for audio transcription. By using these features, you acknowledge that your audio may be processed by these providers in accordance with their respective privacy policies.

9.2 App Stores

If you download Echo Loop from an app store (Apple App Store, Google Play), you also agree to that store's terms of service.

9.3 Third-Party Links

The Services may contain links to third-party websites. We are not responsible for their content or practices. We encourage you to review their terms before engaging with them.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OF TRANSCRIPTIONS

We do not guarantee that the Services will be uninterrupted, error-free, or completely secure. AI transcription results may contain inaccuracies.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHO LOOP SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or goodwill
• Service interruptions or errors
• Inaccuracies in AI-generated transcriptions
• Any actions taken based on transcription results

Our total liability shall not exceed the amount you paid for the Services in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Echo Loop from any claims, damages, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your infringement of any third-party rights
• Your User Content

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting a notice in the app
• Sending an email to registered users
• Updating the date at the top of these Terms

Your continued use after changes become effective constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved in the courts of Hong Kong SAR.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Echo Loop regarding the Services.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

15.3 Waiver

Our failure to enforce any right does not constitute a waiver of that right.

15.4 Assignment

You may not assign these Terms without our consent. We may assign our rights freely.

If you believe content on Echo Loop infringes your copyright, please send a DMCA notice to support@echo-loop.top with:

• Identification of the copyrighted work
• Identification of the infringing material
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
